These Terms & Conditions (the “Terms”) form a binding agreement between you and Miptz Pixel Converter (“Miptz”, “we”, “our” or “us”), a French business registered with the Registre du Commerce et des Sociétés (RCS), and govern your access to and use of miptz.com, including the image conversion, resizing and cropping tools, the blog and any related services we make available (collectively the “Service”). By using the Service you confirm that you have read, understood and agreed to these Terms. If you do not agree, please stop using the Service immediately.
An atelier’s Terms
The Terms below are the small-print backbone of a free, ad-supported tool run by a Parisian atelier. The text is the standard EU-style Terms with a few specific lines that matter for our user base: editorial trademark of the Miptz brand, no implicit licence to redistribute the tool, and a French jurisdiction clause that defaults to the Paris commercial courts. Consumers retain their statutory rights under the Code de la consommation.
1. Eligibility
You must be at least 15 years of age — the age of digital consent in France — to use the Service without parental authorisation. If you are below this age threshold, you may use the Service only with verifiable parental or guardian consent, and we reserve the right to refuse service in jurisdictions where such use is restricted by law. By using Miptz you represent that you have the legal capacity to enter into this agreement and, where you are using the Service on behalf of an organisation, that you are duly authorised to bind that organisation to these Terms.
2. The Service
Miptz provides a browser-based toolkit for converting, resizing and cropping image files. We strive to keep the Service running and accurate, but we do not promise uninterrupted availability and we may suspend, modify or discontinue part or all of the Service at any time, with or without notice. The Service is provided free of charge for ordinary personal and small-business use, subject to fair-use limits described on the upload screens. 3. Acceptable use
You agree not to use the Service for any unlawful, harmful, infringing or otherwise inappropriate purpose, including but not limited to:
- uploading content that you do not own or are not licensed to process, including copyrighted images, trademarks or stock photographs without authorisation;
- uploading material that is illegal under the laws of France, the European Union or your local jurisdiction, including child sexual abuse material, terrorist content, hate-speech material punishable under national criminal law, or content protected by national-security restrictions;
- using the Service to harass, defame, defraud or impersonate any individual or organisation;
- attempting to overload, probe, scan, mirror or otherwise interfere with the technical operation of the Service, including denial-of-service attempts and reverse-engineering of conversion endpoints;
- scraping the website with automated tools, except for the purpose of indexing for public search engines that respect our robots.txt directives;
- reselling, rebranding, sub-licensing or wrapping the Service into a third-party product without a separate written agreement.
We reserve the right to refuse service to anyone violating these rules and to remove any content that breaches them. Where we believe content uploaded to the Service violates the criminal law of France, we may report the matter to the competent national authorities and preserve relevant evidence accordingly.
4. Intellectual property and content ownership
You retain all rights to the images you upload through the converter or resizer, and to the cropped images that the cropper produces inside your browser. By submitting a file to Miptz you grant us a temporary, non-exclusive, worldwide, royalty-free licence solely to host, transcode and deliver the file back to you. This licence ends as soon as the working file is removed from our infrastructure, normally within twenty-four hours.
The Service itself — including the source code, written articles, logos, design system and the Miptz brand name — is owned by Miptz Pixel Converter and is protected by copyright and trademark law. Nothing in these Terms grants you any right or licence to copy, redistribute or create derivative works of the Service except for limited browser-side rendering necessary to use the Service.
5. User-generated content (blog comments and feedback)
If we enable comments or feedback areas, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt and publish that content in connection with the Service. You confirm that you own the content or are otherwise entitled to grant the licence above. We may moderate, edit or remove any user-generated content at our discretion.
6. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Miptz disclaims all warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that conversions are loss-less, that file sizes will be smaller than your originals, or that the Service will be free from interruption, error or vulnerability.
7. Limitation of liability
To the maximum extent permitted by law, Miptz and its founders, employees, contractors and partners shall not be liable for any indirect, incidental, consequential, special or exemplary damages, including without limitation lost profits, lost data, loss of goodwill, business interruption or any other commercial damages, arising out of or in connection with your use of the Service. Our aggregate liability for any direct damages shall not exceed one hundred euros (€100). Some jurisdictions do not allow these exclusions, in which case our liability is limited to the smallest amount permitted by applicable law.
8. Indemnification
You agree to indemnify, defend and hold Miptz Pixel Converter harmless from and against any third-party claims, damages, losses, liabilities, settlements and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of the Service in breach of applicable law, or your infringement of any third-party right through content you submit to the Service.
9. Third-party links and advertising
miptz.com may contain links to third-party websites and may display advertisements provided by Google AdSense, the DoubleClick advertising network or other partners. We do not control, and are not responsible for, the content, policies or practices of any third-party site or advertising network. Your interactions with third parties are governed by their own terms and privacy policies.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including breach of these Terms. The provisions concerning intellectual property, disclaimers, limitation of liability and governing law survive any termination.
11. Governing law and jurisdiction
These Terms are governed by the laws of France, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with the Service or these Terms shall be submitted to the exclusive jurisdiction of the competent commercial courts of Paris, French Republic, except where mandatory consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts. If you are a consumer, your statutory rights under the Code de la consommation (or equivalent legislation in your jurisdiction) remain unaffected by anything in these Terms.
12. Force majeure
We are not liable for any failure or delay in performance to the extent that the failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, civil unrest, governmental action, fire, flood, earthquake, network outage of an upstream provider, denial-of-service attacks, or pandemic-related restrictions. We will resume normal performance as soon as practicable after the force-majeure event ends.
13. Severability and entire agreement
If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy and any additional terms referenced from within the Service, constitute the entire agreement between you and Miptz concerning the Service and supersede any prior agreements, oral or written.
14. Changes to the Terms
We may revise these Terms from time to time to reflect operational, legal or regulatory changes — including amendments to the Code de la consommation or to the data-protection legislation summarised in our Privacy Policy. The “last updated” date at the top of the page reflects the most recent revision. Continued use of the Service after a revision becomes effective constitutes acceptance of the updated Terms. For material changes that affect your rights, we will publish a notice on the home page for a reasonable period after the change takes effect.
